The rules of community-confirmed travel.

Plain-English Terms of Service for KooKoo's community-pooling platform. The mechanic is the contract: pool, threshold, escrow, refund. These terms describe how it works and what you and we are responsible for.

1. What KooKoo is

KooKoo is a data-based, community-driven mobility platform. We are not an airline. We do not own or operate aircraft. We are an orchestration layer that captures community travel demand, matches it to verified charter operators, manages escrow for participant funds, and confirms a flight when the community-defined threshold is met. By using KooKoo, you agree to these Terms.

2. Eligibility

You must be at least 18 years old to commit funds to a community pool. You must provide accurate identifying information when joining a pool, including for KYC checks where required by the jurisdiction or operator. We may refuse service to anyone who fails to meet these requirements.

3. Community pooling and pricing

When you signal intent on a route, you join a pool of travelers heading the same way. The total cost of operating the flight (aircraft, pilot, fuel, taxes, airport fees, KooKoo platform fee) is split equally across all confirmed seats. Every cost component is itemized and visible to every participant. There is no dynamic pricing. Everyone in the same pool pays the same per-seat rate, regardless of when they join.

4. Escrow and refunds

Funds you commit to a pool are held in escrow by an independent third-party trustee from the moment you commit until the flight either departs or the pool fails to confirm. Funds are released to the operator only on confirmed departure. If the pool does not reach its threshold by the lock-by deadline, every participant receives a full refund. No exceptions, no processing fees, no deductions.

5. Money-back guarantee

Your money is protected from the moment you commit to a pool through to your arrival at your destination. If the flight does not confirm, you get your money back. If the flight is confirmed but does not operate, you get your money back. The guarantee is the product, not the fine print.

6. Operators and aircraft

Every operator on the platform is licensed and verified before any seat is sold. KooKoo curates the operator network. Each operator is independently responsible for the operation of the flight, including airworthiness, crew, and safety procedures. KooKoo is not a party to the contract of carriage between the operator and the passenger.

7. Your obligations

You agree to: provide accurate information; appear at the scheduled departure with valid travel documents; comply with operator and airport requirements; not engage in fraudulent, abusive, or illegal activity on the platform. We may cancel your participation, with full refund, if you breach these obligations.

8. Cancellations and changes

Until the lock-by deadline, you can withdraw from a pool and your funds are returned in full from escrow. After the pool confirms and the lock-by deadline passes, the standard charter cancellation terms of the operating carrier apply. Specific cancellation windows and any associated fees are disclosed before you commit to a confirmed pool.

9. Liability

KooKoo's role is the orchestration of demand, supply, and funds. KooKoo is not liable for delay, cancellation, lost baggage, or other incidents arising from the operation of the flight by the carrier. The operator's terms of carriage govern the flight itself. To the maximum extent permitted by law, KooKoo's aggregate liability to you under these Terms shall not exceed the platform fee charged for your booking.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active users by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
